By downloading, installing, or using this Application ("Kaoten"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not download or use this Application.

Your use of the Application constitutes acceptance of these Terms of Service.

We may update these Terms of Service from time to time. We will notify you of any significant changes by updating this page and posting a notice in the Application. Continued use of the Application after changes constitutes acceptance of the updated terms.

4. License Grant

We grant you a non-exclusive, non-transferable, limited license to use the Application on a single mobile device owned or controlled by you for your personal, non-commercial use.

You may not:

• Copy, modify, or create derivative works of the Application
• Reverse engineer, decompile, or disassemble the Application
• Use the Application for commercial purposes without prior written consent
• Transfer or assign your rights under this Agreement

5. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Application for any illegal or unauthorized purpose
• Harassment, abuse, or harming other users
• Infringing upon intellectual property rights of others
• Uploading or transmitting viruses, malware, or harmful code
• Circumventing security measures or accessing the Application without authorization
• Interfering with or disrupting the Application or servers

Violation of these terms may result in termination of your access to the Application.

6. Disclaimers and Warranties

The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We make no warranties regarding:

• The accuracy, reliability, or completeness of face scoring results
• The functionality or performance of the Application
• That the Application will be uninterrupted, timely, secure, or error-free
• That any errors or defects will be corrected

Face scoring results are for entertainment purposes only and should not be relied upon for any purpose.

7. Relationship with Apple

The Application and its services are provided under an end-user license agreement between you, as a user, and us, as a developer. This license agreement is solely between you and us, and does not involve Apple Inc. as a party.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total liability for all claims shall not exceed the total amount of fees paid by you for the use of the Application in the three (3) months immediately preceding the claim (if no fees have been paid, the limit shall be 1,000 JPY).

This limitation shall not apply to damages caused by our willful misconduct or gross negligence.

8. Privacy

Your use of Application is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Application and informs users of our data collection and use practices.

The Application does not use HealthKit or HomeKit frameworks.
